Terms of Service for the Visaland.pl Website

§ 1. Definitions

  1. Service Provider – Visa Land, NIP: 9452141293.

  2. User – a natural person, legal person, or organizational unit without legal personality, established in accordance with applicable law, using the Services provided on the website.

  3. Consumer – a natural person who concludes a service agreement or on whose behalf such an agreement is concluded, for purposes not directly related to their business or professional activity.

  4. Price List – a document specifying the terms and amount of fees for the Services provided by the Service Provider, available on the website.

  5. Service – administrative support provided by specialists dedicated to assisting Users.

  6. Agreement – a service agreement that may be concluded between the Service Provider and the User to regulate matters not covered by these Terms. The provisions of the Agreement shall take precedence over the provisions of these Terms.


§ 2. General Provisions

  1. These Terms have been prepared in accordance with the applicable laws of Poland and define the rules for using the website, as well as the scope of the Service Provider’s liability as an entity providing Services to Users.

  2. The Terms define the scope and conditions of the Services provided by the Service Provider.


§ 3. Intellectual Property Rights

  1. The website contains content protected by copyright, industrial property rights, and other intellectual property rights owned by the Service Provider.

  2. Reproducing, distributing, or otherwise using content from the website, including texts, graphics, trademarks, logos, icons, and photographs, requires prior written consent from the Service Provider.

  3. All intellectual property rights to materials and information made available on the website, including layout and selection of content, navigation solutions, interactive applications, audiovisual materials, forms, templates, and compilations, belong to the Service Provider. This also applies to materials provided electronically to Users, including via email.

  4. It is strictly prohibited to modify, copy, distribute, transmit, display, sublicense, sell, or create derivative works based on the materials described above.

  5. The Service Provider reserves the right to display advertising content on the website, concerning both its own Services and the goods and services of third parties.


§ 4. Conclusion and Duration of the Agreement

  1. The Agreement is concluded upon its effective execution between the Service Provider and the User.

  2. Services paid for by Users who are Consumers shall be made available 14 days after placing the order via the website.

  3. At the express request of the Consumer, confirmed by the waiver of the right to withdraw from the Agreement, Services may be made available prior to the 14-day period, immediately after the Service Provider receives confirmation of payment.

  4. The Service Provider reserves the right to organize promotional campaigns. Participation in a promotion shall not entitle Users who purchased Services before the promotion at a higher price to a refund of all or part of the fees paid.

  5. In the event of a refusal to grant a visa or residence permit, Services purchased at a promotional price are non-refundable.

  6. The Service Provider may terminate the Agreement with immediate effect in the event that the User breaches the provisions of the Terms or the Agreement.


§ 5. Payment for Services

  1. The User agrees to make payments and to receive confirmations of completed transactions at the email address: hello@visaland.pl.

  2. Payments for Services may be made via bank transfer or through a generated payment link.


§ 6. Withdrawal from the Agreement

  1. Consumers have the right to withdraw from a service agreement concluded via the website within 14 days of its conclusion, with the right to a refund of costs incurred.

  2. After the 14-day period, Consumers may stop using the Services without the right to a refund.

  3. The right of withdrawal does not apply to Users who are not Consumers, unless otherwise specified in a separate Agreement.

  4. Withdrawal from the Agreement shall be made by submitting a clear statement via email to: hello@visaland.pl.


§ 7. Personal Data Processing

  1. The administrator of Users’ personal data is the Service Provider – Visa Land, NIP: 9452141293.

  2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the rules set out in the Privacy Policy.

  3. The scope of processed data includes, in particular, identification, address, contact information, educational and professional experience, family members, and any legal violations.

  4. Data may be used for the provision of Services and to verify eligibility for the appropriate type of residence permit.

  5. Personal data may only be disclosed upon request by competent state authorities.

  6. The Service Provider declares that the website uses cookies.


§ 8. Complaints Procedure

  1. Complaints regarding Services provided via the website should be submitted in writing or by email to: hello@visaland.pl.

  2. Complaints shall be considered promptly, no later than within 30 days of receipt.

  3. A complaint should include a description of the event, the User’s name, and email address.


§ 9. Liability of the Service Provider

  1. To the fullest extent permitted by Polish law, the Service Provider is not responsible for the success of visa or residence permit procedures.

  2. The Service Provider’s liability to the User is limited to the amount of the fee paid for the relevant Service.


§ 10. Changes to the Terms

  1. The Service Provider reserves the right to amend the Terms.

  2. Changes to the Price List do not require amendments to the Terms.

  3. Users shall be informed of changes to the Terms through the publication of the updated Terms on the website.


§ 11. Dispute Resolution

  1. The law applicable to the Agreement is the law of Poland.

  2. All disputes shall be resolved by the competent common courts with jurisdiction over the Service Provider’s registered office.
